GENERAL TERMS AND CONDITIONS OF SALE – CONSUMERS (B2C)
Preamble
Any order placed for products presented on the website https://www.mojo-borntochill.com (hereinafter the “Website”) implies full and unconditional acceptance of these General Terms and Conditions of Sale (hereinafter the “GTC”).
These GTC apply exclusively to consumers within the meaning of the French Consumer Code. They prevail over any other conditions, unless expressly agreed in writing by MOJO CONNECTION.

2. Acceptance of the Terms
Acceptance of these GTC is evidenced by the validation of the order and payment. This validation constitutes an electronic signature and a binding contractual commitment.
3. Products
Products are described as accurately as possible. Photographs, illustrations and descriptions are provided for information purposes only and are not contractual.
Minor variations may occur, particularly for technical or aesthetic improvements, without affecting the essential characteristics of the products.
4. Availability
Offers are valid while stocks last. In the event of unavailability after an order has been placed, the customer will be informed by email and may choose between a refund or an equivalent product.
5. Order
Automated recording systems constitute proof of the order. The sale is deemed concluded once the order confirmation email has been sent by MOJO CONNECTION.
MOJO CONNECTION reserves the right to cancel any order in the event of a previous payment dispute.
6. Delivery
Products are delivered to the address indicated by the customer when placing the order.
Delivery takes place within a maximum period of 30 days from the day following the order, in accordance with Article L216-1 of the French Consumer Code.
In the event of a delay exceeding 30 days, the customer may terminate the contract under the conditions set out in Article L216-6 of the French Consumer Code.
Risk is transferred to the customer upon physical receipt of the products.
7. Force Majeure
MOJO CONNECTION shall not be held liable in the event of force majeure as defined by French case law.
8. Right of Withdrawal
In accordance with Articles L221-18 to L221-28 of the French Consumer Code, the customer has a period of 14 calendar days from receipt of the products to exercise the right of withdrawal, without having to justify any reason.
Returned products must be new, unused, and in their original packaging, including all accessories.
Return shipping costs remain the responsibility of the customer.

Refunds will be issued within 14 days of receipt of the returned products or proof of shipment.
Personalised products are excluded from the right of withdrawal.

9. Prices
Prices are expressed in euros, all taxes included (VAT). Delivery costs are indicated before order validation.
MOJO CONNECTION reserves the right to modify prices at any time; the applicable price is the one in force on the date of the order.
10. Payment
Payment is due in full at the time of order. Accepted payment methods are credit card, bank transfer and cheque.
Credit card payments are secured via the PAYPLUG payment solution.
11. Retention of Title
In accordance with Article 2367 of the French Civil Code, products remain the property of MOJO CONNECTION until full payment of the price, including any ancillary costs.

MOJO CONNECTION’s liability is limited to the amount of the order, except in cases of bodily injury or gross negligence.

15. Consumer Mediation
In accordance with Article L612-1 of the French Consumer Code, the customer may use a consumer mediation service free of charge after having first submitted a written complaint to MOJO CONNECTION.

16. Applicable Law – Disputes
These GTC are governed by French law. In the event of a dispute, the consumer may bring the matter before the competent court of their place of residence.
